By purchasing any product (Software) from FME, you agree to the following terms (Agreement):
- We are the copyright holder of the Software. The Software, or any portion of it, is a copyrightable matter and is protected by law. You may not use any part of the code, in whole or in part, in any other software, product, or website.
- You may not give, sell, distribute, sublicense, rent, lease, or lend any portion of the Software or Documentation to anyone.
- You may not give, sell, distribute, sublicense, rent, lease, or lend any portion of the Software or Documentation to anyone.
- You may not place the Software on a server that makes it accessible via a public network, such as the Internet, for distribution purposes.
- You are required to preserve the copyright information, including the text and links at the bottom of the templates.
- We reserve the right to publish a selected list of buyers of our Software.
- We will not be liable for any damages, including loss of profits, savings, or incidental/consequential damages, arising from your use or inability to use this Software.
- We are not liable for any prosecution arising from your use of this Software in violation of the law or for any illegal activity.
- Failure to use the Software in accordance with the terms and conditions of this License Agreement constitutes a breach, resulting in the revocation of your license to use the program.
- FME reserves the right to change this License Agreement at any time and to enforce its clauses at any given moment.
- This License Agreement remains effective until terminated. We reserve the right to terminate your license to use the Software at any time if, in our sole discretion, you fail to comply with the terms of the Agreement, including but not limited to obscuring or removing any link or copyright notice as specified herein. You may terminate this Agreement at any time by destroying all copies of the Software. Termination does not obligate us to refund any amount spent on the purchase of the Software.
- If you continue to use this Software after FME provides notice of termination of your license, you agree to accept an injunction preventing further use and to pay all costs, including reasonable attorney fees, incurred to enforce the revocation of your license and any damages suffered by us due to your misuse of the Software.
Upgrades
- We provide our customers with free upgrades for the products they purchase, limited to the product version branch. This means that by purchasing a product version 1.x, customers will receive free updates for all versions within that branch (1.x, 1.x.x).
- Customers are notified via email about updates, which they can download from the Downloadable Products area after logging in.
Email Address
- The email address provided must be valid, as it will be used for communication purposes. It is strongly recommended to use an email address associated with your company. While free email addresses can be used for registration and checkout, orders placed with free email service addresses will be subject to more thorough verification, which may result in longer activation times.
Download
- All products are available for download once payment has been accepted and verified. If you are unable to download a product, please check the status of your payment through the payment processor's interface or contact us for assistance.
We Reserve The Right
- We reserve the right to refuse support and/or customization for certain types of sites, including but not limited to the following: adult toys, sex-related content, alcohol, and any illegal drug-related sites.
Refunds
- To ensure your protection, we offer a 45-day money-back guarantee for all our software products. If you are dissatisfied with a product within 15 days of purchase due to its failure to fulfill the described functionality, you are eligible for a full refund.
- To request a refund, please submit a request that includes your Transaction ID. Please note that we do not provide refunds for installation and customization services. Refunds will only be processed upon receiving an email from you (using the purchase email) that includes a justified reason for the refund request.
